1. Age Requirements

3. User Conduct and Acceptable Use

Acceptable Use: You agree to use the Service for its intended productivity and focus purposes, respect other users, and follow community guidelines.

Prohibited Conduct: You must NOT:

• Use cheats, exploits, bots, hacks, or unauthorized third-party software to manipulate leaderboards or statistics
• Engage in harassment, bullying, hate speech, or share inappropriate content
• Impersonate others or misrepresent your identity
• Attempt unauthorized access to the Service or other accounts
• Reverse engineer, decompile, or disassemble the Service
• Use the Service for commercial purposes without permission
• Violate any applicable laws or regulations

4. Intellectual Property Rights

4.1 Ownership

The Service and ALL its original content, including but not limited to software code, algorithms, timer mechanics, user interface designs, graphics, logos, text, audio, video, trade dress, and all intellectual property rights therein, are the exclusive property of Rawi Studios and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

4.2 Limited License Grant

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for personal, non-commercial productivity purposes in accordance with these Terms.

4.3 Trade Secrets and Confidential Information

The Service contains valuable trade secrets including proprietary algorithms, timer logic, anti-cheat systems, database architectures, and business methods. These trade secrets are protected under the Defend Trade Secrets Act (18 U.S.C. § 1831-1839) and applicable state trade secret laws.

4.4 Anti-Cloning and Copycat Prohibition

You are expressly prohibited from creating, distributing, or operating any application, game, service, or product that copies, imitates, or is substantially similar to PomoLuxe's functionality or design. Creating a "clone" or "copycat" application constitutes willful infringement of our intellectual property rights.

4.5 User-Generated Content

By submitting content to the Service, you grant Rawi Studios a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such content.

5. Virtual Items and Points

We reserve the right to modify leaderboard rules, point systems, or features at any time. Virtual items, points, streaks, or achievements have no real-world value and cannot be exchanged for real money.

6. Privacy and Data Protection

Your use is governed by our Privacy Policy. By using the Service, you consent to our collection and use of data as described therein.

7. Third-Party Services

We are not responsible for third-party websites or services linked from our Service, including Firebase, YouTube, and Spotify.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAWI STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Indemnification

You agree to defend, indemnify, and hold harmless Rawi Studios from any claims arising from your violation of these Terms, violation of any rights of another party, or your use of the Service.

10. Dispute Resolution

These Terms are governed by the laws of the applicable jurisdiction. Disputes shall be resolved through professional mediation or binding arbitration where permitted.

11. Termination

We may terminate or suspend your account immediately for breach of Terms, legal requirements, or risk to the Service. Upon termination, your right to use the Service ceases immediately.

12. DMCA/Copyright Policy

To report copyright infringement, contact our DMCA agent at support@rawistudios.com with a description of the work and location of infringing material.

13. Modifications to Terms

We reserve the right to modify these Terms. Material changes will be notified at least 30 days before taking effect. Continued use constitutes acceptance of modified Terms.
